International Patent Applications

The Patent Cooperation Treaty is the international patent law created in 1970 that established the regulated steps to file patent applications to protect the product or service in its originating country. All international applications are called PCT applications.

Applications go through several phases:

Chapter I: Filing the application with a Receiving Office

International patent search by the International Searching Authority

Publication of application with any amendments taking search results into consideration

Written opinion of the search division is issued regarding patentability

Chapter II: An initial examination is conducted by the International Preliminary Examination Authority (optional), with the result being another written opinion of the examination division

Translations and filing of national and/or regional patent applications for approval and issuing the patent
